Entschädigung

Sie erklären sich damit einverstanden, Tides, seine leitenden Angestellten, Direktoren, Mitarbeiter und Vertreter von und gegen alle Ansprüche, Schäden, Verpflichtungen, Verluste, Verbindlichkeiten, Kosten oder Schulden und Ausgaben (einschließlich, aber nicht beschränkt auf Anwalts- Gebühren), die sich aus: (i) Ihrer Nutzung und Ihrem Zugriff auf die Websites ergeben; (ii) Ihre Verletzung einer Bestimmung dieser Bedingungen; (iii) Ihre Verletzung von Rechten Dritter oder einem Gesetz, einschließlich, aber nicht beschränkt auf Urheberrechte, Eigentums- oder Datenschutzrechte; oder (iv) jegliche Behauptung, dass Inhalte, die Sie über die Websites einreichen, gegen Rechte Dritter oder Gesetze verstoßen. Diese Verteidigungs- und Freistellungsverpflichtung gilt über diese Bedingungen und Ihre Nutzung der Websites hinaus.

 

Möglichkeit, die Nutzungsbedingungen zu akzeptieren

Sie bestätigen, dass Sie in Ihrer Gerichtsbarkeit die Volljährigkeit erreicht haben oder die Zustimmung der Eltern oder Erziehungsberechtigten besitzen und voll in der Lage und befugt sind, diesen Bedingungen zuzustimmen und diese einzuhalten. Allgemeines

These Terms shall be governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles. Any claim or dispute between you and us that arises in whole or in part from the Websites shall be decided exclusively by a court of competent jurisdiction located in the State of California. These Terms, together with the Privacy Policy and any other legal notices published by us on the Websites, shall constitute the entire agreement between you and us concerning the Websites. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. YOU AND TIDES AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE WEBSITES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
