Kompensacija

Jūs sutinkate ginti, atlyginti nuostolius ir laikyti nekenksmingus Tides, jos pareigūnus, direktorius, darbuotojus ir agentus nuo bet kokių pretenzijų, žalos, įsipareigojimų, nuostolių, įsipareigojimų, išlaidų ar skolų ir išlaidų (įskaitant, bet neapsiribojant advokatų) mokesčiai), atsirandantys dėl: (i) jūsų naudojimosi svetainėmis ir prieigos prie jų; (ii) pažeidėte bet kurią šių Sąlygų sąlygą; (iii) pažeidėte bet kokias trečiosios šalies teises arba bet kurį įstatymą, įskaitant, bet neapsiribojant, bet kokias autorių teises, nuosavybės ar privatumo teises; arba (iv) bet kokius teiginius, kad turinys, kurį pateikiate per svetaines, pažeidžia bet kokias trečiosios šalies teises ar bet kurį įstatymą. These Terms shall be governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles. Any claim or dispute between you and us that arises in whole or in part from the Websites shall be decided exclusively by a court of competent jurisdiction located in the State of California. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. YOU AND TIDES AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE WEBSITES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
