These Terms and Conditions of Use (“Terms”) apply to the websites of Beyond100K, a fiscally sponsored project of the Tides Center, a California nonprofit public benefit corporation (“we,” “us,” “our”), located at https://beyond100k.org, https://uncommission.org, https://grandchallenges.100kin10.org, https://pathto100k.org, and https://www.starfishinstitute.org (the “Websites”).

Vergoeding

U stemt ermee in om Tides, haar functionarissen, directeuren, werknemers en agenten te verdedigen, schadeloos te stellen en te vrijwaren van en tegen alle claims, schade, verplichtingen, verliezen, aansprakelijkheden, kosten of schulden en uitgaven (inclusief maar niet beperkt tot advocaten' vergoedingen) die voortvloeien uit: (i) uw gebruik van en toegang tot de Websites; (ii) uw schending van een voorwaarde van deze Voorwaarden; (iii) uw schending van enig recht van derden of enige wet, inclusief maar niet beperkt tot auteursrechten, eigendomsrechten of privacyrechten; of (iv) enige claim dat inhoud die u indient via de Websites in strijd is met het recht van derden of enige wet. Deze verplichting tot verdediging en vrijwaring zal deze Voorwaarden en uw gebruik van de Websites overleven.

 

Mogelijkheid om gebruiksvoorwaarden te accepteren

U bevestigt dat u meerderjarig bent in uw rechtsgebied of in het bezit bent van wettelijke toestemming van uw ouders of voogd en dat u volledig in staat en bevoegd bent om akkoord te gaan met en zich te houden aan deze Voorwaarden. U bevestigt ook dat u ten minste 16 jaar oud bent, aangezien deze websites niet bedoeld zijn voor personen onder de 16 jaar.

 

Toewijzing

Deze voorwaarden en alle rechten en licenties die hieronder worden verleend, mogen niet door u worden overgedragen of toegewezen, maar kunnen door ons zonder beperking worden toegewezen.

 

Algemeen

These Terms shall be governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles. Any claim or dispute between you and us that arises in whole or in part from the Websites shall be decided exclusively by a court of competent jurisdiction located in the State of California. These Terms, together with the Privacy Policy and any other legal notices published by us on the Websites, shall constitute the entire agreement between you and us concerning the Websites. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. YOU AND TIDES AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE WEBSITES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
