These Terms and Conditions of Use (“Terms”) apply to the websites of Beyond100K, a fiscally sponsored project of the Tides Center, a California nonprofit public benefit corporation (“we,” “us,” “our”), located at https://beyond100k.org, https://uncommission.org, https://grandchallenges.100kin10.org, https://pathto100k.org, and https://www.starfishinstitute.org (the “Websites”).

איר שטימען צו באַשיצן, באַשייַמפּערלעך און האַלטן ומשעדלעך טיידז, זייַן אָפיציר, דירעקטאָרס, עמפּלוייז און אגענטן, פֿון און קעגן אַלע קליימז, דאַמידזשיז, אַבלאַגיישאַנז, לאָססעס, לייאַביליטיז, קאָס אָדער כויוו און הוצאות (אַרייַנגערעכנט אָבער ניט לימיטעד צו אַדוואָקאַטז). פיז) ערייזינג פון: (איך) דיין נוצן פון און אַקסעס צו די וועבסיטעס; (ii) דיין הילעל פון קיין טערמין פון די תּנאָים; (iii) דיין הילעל פון קיין דריט-פּאַרטיי רעכט אָדער קיין געזעץ, אַרייַנגערעכנט אָן באַגרענעצונג קיין קאַפּירייט, פאַרמאָג אָדער פּריוואַטקייט רעכט; אָדער (יוו) קיין פאָדערן אַז אינהאַלט איר פאָרלייגן דורך די וועבסיטעס ווייאַלייץ קיין דריט פּאַרטיי רעכט אָדער קיין געזעץ. די פליכט פון פאַרטיידיקונג און ינדעממאַניישאַן וועט בלייַבנ לעבן די תּנאָים און דיין נוצן פון די וועבסיטעס.

 

פיייקייט צו אָננעמען תּנאָים און קאָנדיטיאָנס פון נוצן

איר באַשטעטיקן אַז איר האָט ריטשט די עלטער פון מערהייַט אין דיין דזשוריסדיקשאַן אָדער פאַרמאָגן לעגאַל פּערענטאַל אָדער גאַרדיאַן צושטימען און זענען גאָר ביכולת און קאָמפּעטענט צו שטימען צו און האַלטן די תּנאָים. איר אויך באַשטעטיקן אַז איר זענט בייַ מינדסטער 16 יאָר אַלט, ווייַל די וועבסיטעס זענען נישט בדעה פֿאַר ווער עס יז אונטער די עלטער פון 16.

 

Assignment

די תּנאָים און קיין רעכט און לייסאַנסיז געגעבן דאָ, קען נישט זיין טראַנספערד אָדער אַסיינד דורך איר, אָבער קען זיין אַסיינד דורך אונדז אָן ריסטריקשאַן.

 

אַלגעמיין

These Terms shall be governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles. Any claim or dispute between you and us that arises in whole or in part from the Websites shall be decided exclusively by a court of competent jurisdiction located in the State of California. These Terms, together with the Privacy Policy and any other legal notices published by us on the Websites, shall constitute the entire agreement between you and us concerning the Websites. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. YOU AND TIDES AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE WEBSITES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
